With a practice rooted in the area of insurance defence litigation, Dalton focuses on property and casualty. Dalton has extensive experience in the defence of motor vehicle and occupiers’ liability actions as well as the investigation of potentially fraudulent insurance claims by means of examinations under oath. Dalton provides practical, cost-effective advice and tenacious advocacy to assist insurers, municipalities, product manufacturers and businesses in achieving their goals. Dalton’s experience includes:

  • Jury trial lead counsel in the Superior Court of Justice (Ontario) in a motor vehicle accident case where liability and damages were in dispute (2018 jury decision CV-12-703).
  • Counsel in the Superior Court of Justice (Ontario) seeking summary judgment in an occupier’s liability action (2017 ONSC 61 CanLII)
  • Trial counsel in the Superior Court of Justice (Ontario) in a solicitor’s negligence case where liability and damages were in dispute (2015 ONSC 6217 CanLII)
  • Counsel in a 9-week jury trial at the Superior Court of Justice (Ontario), including a week-long voire dire on the admissibility of expert evidence, in a motor vehicle accident case involving allegations of a traumatic brain injury (2012 jury decision CV-09-45524)
